LOTUS RANCH GUEST AGREEMENT

 

 

Deposits: A deposit equal to one night lodging is required at the time of reservation. Your balance will be charged 14 days prior to arrival.

Cancellations: Reservations cancelled 30 days or more prior to your arrival date is fully refundable less a $50.00 service fee. If you should cancel your reservation within less than 30 days of your expected arrival, your payment will be refunded to you less a $50.00 service fee if and only if, the property you reserved is rebooked for the same dates. If it is not rebooked, your entire payment is non-refundable. Refunds will be made by check or credit card to your bankcard account. Sorry, cancellations within 24 hours of your scheduled arrival date are non-refundable. Guests who choose to shorten their stay while in residence are still subject to the cancellation policy and are responsible for the full balance due on their reservation.

Lotus Ranch LLC, 525 Fischer Trail / Wimberley, TX 78676

1. The guest agrees to compensate Lotus Ranch LLC for any damages caused by their carelessness or negligence, including missing or damaged property. This is a NON-SMOKING PROPERTY – If you choose to smoke in the room a $500.00 (for two bedroom or less) or $1,000.00 (for three bedroom or more) comprehensive fee will be assessed. Smoking outside is discouraged however if you must police your butts and beware of the extreme fire hazard due to drought conditions.

2.Hurricane or Storm Policy – No refunds will be given unless: a. The National Weather Service orders mandatory evacuation in a "Tropical Storm/Hurricane Warning area "and/or

b. A "mandatory evacuation order has been given for the "Tropical Storm/Hurricane Warning," area we will refund:

1. Any unused portion of rent from a guest currently registered,

2. Any unused portion of rent from a guest that is scheduled to arrive, and wants to shorten their stay, to come in after the Hurricane Warning is lifted; and

3. Any advance rents collected or deposited for a reservation that is scheduled to arrive during the "Hurricane Warning" period.

3. Guest(s) acknowledges and respects the peace and quiet of the Wimberley community. As such there will be no loud music or other sounds made which could disturb neighbors. Lotus Ranch LLC has the prerogative to terminate this agreement and ask disruptive Guest(s) to vacate. Guest(s) acknowledges and understands that this reservation is only for the number of adults and children listed herein below. Septic system capacity requires adherence to this maximum number. NO HOUSE PARTIES (INVOLVING OTHERS THAN REGISTERED GUESTS) WILL BE PERMITTED WITHOUT THE SPECIFIC ADVANCE APPROVAL OF Lotus Ranch LLC. Violators will be asked to leave and there will be no refund of any money for the time remaining on their reservation. NO PETS ARE ALLOWED.

4. Guests agree not to start any fires. The City of Wimberley (and Hays County) has specific laws relating to the burning of refuge, camp fires, etc…and Guests agree not to start any such fires.

5. Guests agree not to use any of Lotus Ranch LLC or the owner’s personal belongings or equipment. Guests hereby accept sole responsibility for any such costs, expenses and bills that may arise from damage to personal belongings and equipment.

6. Guests understand that they are renting a private facility located in the Texas Hill Country. As such, Guests understand that there are snakes, scorpions, and other wild animals/insects that the owner of 525 Fischer Trail / Wimberley, TX 78676 cannot control or eliminate. Moreover, this property may be located on a natural wildlife managed property; while Lotus Ranch LLC and/or the owner of 525 Fischer Trail / Wimberley, TX 78676 has taken reasonable precautions to insure the safety of its guests, you should use common sense and extreme caution when outdoors. Proper shoes or boots should be worn when hiking due to the rough and rocky terrain.

7. The home at 525 Fischer Trail, Wimberley, TX 78676 is privately owned; the homeowner or Lotus Ranch LLC are not responsible for any accidents, injuries or illness that occurs while on the premises or its facilities. The Homeowner or Lotus Ranch LLC are not responsible for the loss of personal belongings or valuables of the guest. By accepting this reservation, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premise.

8. RELEASE AND INDEMNITY: This accommodation includes access to porches, decks, ponds, hot tubs, natural wildlife, and surrounding property. Guest(s) use of these facilities is at their own risk. Adults are responsible for the safe conduct of all children on the premises and shall take all appropriate measures to assure their safety. Guest(s) holds Lotus Ranch LLC and property owner harmless from any and all liability for damages and/or injuries resulting to Guest(s) or any invitees of Guest(s) whether said injury or loss is caused by any negligence or not. By signing below, Guest acknowledges that he/she has informed all other Guests/invitees of the terms of this Agreement and that all have consented to be bound thereby.

9.Signature. By signing below, the signing guest acknowledge that he/she has informed all others involved in the reservation of this Property of the terms of this Agreement and that all have consented to be bound by this Agreement. This agreement is a material term of the rental agreement.

Directions to Wimberley

From Austin: Take 290 West to Dripping Springs and turn south on RR 12 after the Home Depot. Drive about 15 miles to Wimberley and turn right just after the ACE Hardware on FM 2325 towards Blanco. Go approx. 3 miles to Fischer Store Road and turn left (south). Go ½ mile to Fischer Trail and turn left. Go exactly .5 miles to the end of this gravel road and turn left at the Lotus Ranch sign (525). The guest quarters lodge will be on your right.

From Houston: Take IH 10 toward San Antonio and take Luling exit (Hwy.80). Continue on 80 through Luling to San Marcos. After you pass under IH 35, Hwy. 80 become RR 12. Continue through center on RR 12. Continue approximately 12 miles to the junction of RR 12 and CR 32. Continue approximately 4 ½ miles through Wimberley to FM 2325 make a left towards Blanco. Go approx. 3 miles to Fischer Store Road and turn left (south). Go ½ mile to Fischer Trail and turn left. Go exactly .5 miles to the end of this gravel road and turn left at the Lotus Ranch sign (525). The guest quarters lodge will be on your right.

From San Antonio: Take IH 35 North to San Marcos. Exit 205, RR 12 and /or Wimberley. Stay on RR 12 through center of San Marcos. Turn right at traffic light, you will see the Wimberley sign on the right, remaining on RR 12. Continue on RR 12 approximately 12 miles to the junction (flashing light) veer right this will still be RR 12 continue approximately 4 ½ miles through Wimberley to FM 2325 make a left towards Blanco. Go approx. 3 miles to Fischer Store Road and turn left (south). Go ½ mile to Fischer Trail and turn left. Go exactly .5 miles to the end of this gravel road and turn left at the Lotus Ranch sign (525). The guest quarters lodge will be on your right.
